Content: comments, reviews, stories, chapters, images, video, or any other material posted to a site hosted by Litsam.
Participant: an author, reader or other person with an account at Litsam, or who interacts with Litsam hosted materials in some manner.
Claimant: a person making an allegation of infringement against material hosted by Litsam.

DMCA/COPYRIGHT INFRINGEMENT POLICY:

Litsam believes the protection of intellectual property is core to the freedom of creativity. Litsam is committed to helping the legitimate owner of a copyright protect their property, whether that owner is a Participant, or a Claimant.

Copyright Claims
To submit a copyright claim you must be the legitimate copyright holder, or an authorized party of same. A DMCA Takedown Notice may be sent to disputes@litsam.com with the subject “DMCA Claim”, or may be mailed to ATTN: DMCA Claims, Litsam, Inc. 1218 NE 184th St, Shoreline, WA 98155
To be valid, a claim must:

  1. Contain an electronic or physical signature of the copyright owner, or a person authorized to act on behalf of the owner.
  2. Identify an exclusive copyright that has allegedly been infringed. In the case of multiple related works, identify a representative sample of such works sufficient to uniquely identify the material alleged to infringe.
  3. Identify the material against which the claim of infringement is lodged with sufficient specificity that Litsam can identify and locate the work(s) without ambiguity. In the case of multiple works, each representative sample should be associated with a specific claimed infringement.
  4. Provide Litsam with contact information for the Claimant, including address, telephone number and email.
  5. Include a statement that the Claimant has a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law, and that it does not fall under Fair Use law.
  6. Provide a statement that the information in the notification is accurate, and under penalty of perjury, that the Claimant is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

On receipt of a valid DMCA takedown notice, Litsam will attempt to notify the Participant against whom the claim is lodged and will remove or disable access to the material(s) against which the complaint is lodged promptly.

Counter Notification Policy
If your content is removed and/or you receive a notice of copyright or trademark infringement, you may provide Counter Notification by emailing disputes@litsam.com with a subject of “Counter Notification: [name]” and including the following:

  1. An electronic signature of the person taking legal responsibility for the allegedly infringing material.
  2. Identification of the material which has been removed or to which access was disabled as a result of the claim.
  3. The name, address and telephone number of the party taking legal responsibility for the material, along with a statement that this person consents to the jurisdiction of the Federal District Court for the district of Washington, and that the responsible party will accept service of process from the Claimant or an agent of such party.

Upon receipt of a Counter Notification, Litsam shall promptly provide the Claimant with a copy of the Counter Notification, and inform such party that it will replace the removed material or cease disabling access to it until and unless Claimant procures a court order restraining Participant from engaging in infringing activity relating to the materials on Litsam’s sites.

It is Litsam’s policy to terminate accounts with, in Litsam’s sole opinion, repeat or egregious violations. Persons with terminated accounts are barred from opening a new account on Litsam without explicit written permission.
